Class 3 Ebikes: The 28 MPH Commuter Class
Class 3 exists for one job: replacing car trips on roads where 20 mph makes you an obstacle. It does that job better than anything else and asks for more in return than most buyers expect.

Class 3 is the only ebike class that lets a motor help you past 20 mph. The cutoff moves to 28, and everything else about the category follows from that one number: the age minimum, the helmet rules, the path bans, the speedometer requirement, and a range figure that can be half what the same bike would deliver at a lower speed.
The eight extra miles per hour sound modest. On a suburban arterial with 35 mph traffic, they are the difference between being an obstacle drivers have to solve and being traffic that flows. That is the entire case for Class 3, and it is a strong one for a specific rider on a specific route.

What Class 3 specifies
The model language adopted by most of the roughly forty three-class states defines Class 3 as an electric bicycle equipped with a speedometer and a motor that provides assistance only when the rider is pedaling, and that ceases to provide assistance when the bicycle reaches 28 miles per hour.
Three requirements sit inside that: pedal assist only, a 28 mph cutoff, and a speedometer. A handful of states depart from the pedal-only clause and permit a throttle on a Class 3 bike provided the throttle itself stops helping at 20 mph, which is why some US Class 3 bikes ship with a thumb throttle that quietly stops working as you pass 20. That is a state-by-state matter and worth confirming locally rather than assuming.
The 750W federal power cap still applies. Class 3 is not a more powerful class; it is a faster-assisting one. A 500W Class 3 commuter and a 750W Class 2 fat bike sit on opposite sides of that distinction, and the fat bike is the one with more motor.
It is worth noticing how permissive the American approach is by comparison. In the EU, a bike that assists to 45 km/h, which is 28 mph, is a speed pedelec and is generally regulated as a moped: registration, a plate, insurance, and a moped-rated helmet in most member states. The US chose to keep the same machine inside the bicycle category with a short list of conditions attached. Those conditions are the price.
What 28 mph actually changes about commuting
Speed differential is the variable that matters, not speed. A cyclist at 20 mph on a road where cars run 40 has a 20 mph differential, which is where most passing conflicts come from. At 28, the differential drops to 12, and the character of the road changes. Drivers wait behind you for shorter periods. Passes are less rushed. Right hooks at intersections happen with less closing speed.
The trip time math is also less obvious than it looks. Doubling assist speed does not halve commute time, because stops, lights, corners, and the slow first and last quarter mile do not scale. A realistic 10 mile suburban commute might drop from 38 minutes to 28, roughly a quarter faster. That quarter is often the difference between a commute someone keeps doing and one they abandon after three weeks.
Where the extra speed does very little is dense city riding. Downtown, the average speed is set by traffic lights and pedestrians, not by your motor. A Class 3 bike in a stop-and-go urban core spends most of its time below 20 mph and delivers almost none of the benefit while carrying all of the restrictions. Class 3 pays off on open suburban and semi-rural road, and it is nearly wasted in a city center.
Pedal assist only, plus a speedometer, and why both
The pedal-only requirement in most states is not an oversight or a compromise. It follows from the federal definition. The Consumer Product Safety Act defines a low-speed electric bicycle in part by a maximum speed under motor power alone of less than 20 mph with a 170 lb rider on level ground. That is the threshold governing what may be sold as a bicycle. A machine that will do 28 mph on a throttle alone falls outside that definition and is not a bicycle federally, regardless of what any state calls it.
Pedal assist threads the needle. The motor helps to 28, but the bike cannot propel itself past 20 without a pedaling rider, so it stays inside the federal category. This is also why the states permitting a Class 3 throttle cap that throttle at 20: they are staying on the right side of the same line.
The speedometer requirement is about compliance you can actually perform. Class 3 riders are the ones most likely to encounter a posted speed limit on a shared facility, and a 15 mph path limit is unenforceable by a rider with no readout. Every Class 3 bike ships with a display that satisfies this, so it is not a spec you need to shop for, but it does mean a bare-bones bike with no display cannot legally be a Class 3 bike.
Age 16, helmets, and the path bans
Class 3 carries the longest list of conditions of the three classes, and they cluster in three places.
Minimum age
Most three-class states set 16 as the minimum age to operate a Class 3 ebike. Class 1 and Class 2 typically have no age minimum at the state level. Many states allow a passenger under 16 on a Class 3 bike equipped to carry one, which is a distinction parents often miss. If you are shopping for a rider under 16, this is a hard gate and it is the main reason the teen market is Class 1 and Class 2.
Helmets
Helmet requirements for Class 3 are far more common than for the other classes, and several states require a helmet for all Class 3 riders regardless of age rather than only for minors. California is the widely cited example. This is one of the few ebike rules that is routinely enforced, and given the energy involved at 28 mph, it is also one worth following on its merits.
Where you cannot ride
The typical pattern in state law is that Class 3 is permitted on roads and in on-street bike lanes, and prohibited on separated multi-use paths, bike paths, and unpaved trails unless the local authority with jurisdiction specifically allows it. Some states invert the default and let localities opt out instead of opt in. Either way, the operative decision is local.
This is the restriction that ruins Class 3 purchases. A rider buys a 28 mph bike for a commute that runs eight miles along a greenway, then discovers the greenway is Class 1 and 2 only. Treat the path and helmet rows as the general pattern. These vary by state and, for path access, by individual trail authority within a state.
The range cost of 28 mph is not a small penalty
This is the part buyers underestimate most, and it is pure physics rather than a manufacturing shortcoming.
Aerodynamic drag force rises with the square of speed. Power is force times velocity, so the power needed to overcome drag rises with the cube of speed. Going from 20 mph to 28 mph is a factor of 1.4 in speed, and 1.4 cubed is about 2.75. Rolling resistance and drivetrain losses scale closer to linearly, so once you blend everything together, holding 28 mph on flat ground takes roughly twice the total power of holding 20.
Since you are covering only 1.4 times the distance in that time, energy per mile rises by something close to 40 to 50 percent even in the best case, and considerably more once you account for the motor working harder and the rider contributing a fixed fraction. The practical result riders report is close to half the range at 28 mph compared to the same bike ridden at 20.

These are order-of-magnitude figures for an upright rider on an unfaired commuter bike, and they move a lot with rider size, riding position, tire choice, and wind. The shape of the curve is the reliable part: the cost of speed accelerates. The last 3 mph is far more expensive than the first 3.
Two things follow. First, buy more battery than you think you need if you plan to actually use 28 mph. On a Class 3 commuter, 700 Wh is a sensible floor and 900 Wh or more is not excessive. What a bike needs to be a decent 28 mph bike
Plenty of bikes carry a Class 3 label without being built for the speed. The label costs a manufacturer nothing; the hardware does. Four things separate a real Class 3 commuter from a Class 2 bike with the limiter raised.
Brakes. Kinetic energy scales with the square of speed, so a stop from 28 mph dissipates roughly twice the energy of a stop from 20. Add rider and bike weight of 250 lb or more and you need hydraulic discs, 180 mm rotors front and rear, and preferably four-piston calipers if you ride hills. Mechanical discs on a Class 3 bike are a mismatch, and rim brakes are disqualifying.
Gearing tall enough to reach the cutoff. This one catches people. To pedal at 28 mph at a comfortable 85 to 90 rpm, you need a high gear somewhere around 100 to 115 gear inches. A budget bike with a 48 tooth chainring and a 7 speed freewheel whose smallest cog is 14 teeth tops out around 25 mph at that cadence. You spin out before the motor stops helping, which means you paid for a 28 mph bike you cannot ride at 28 mph. Check the smallest rear cog and the chainring size. Tires and stability. Narrow high-pressure tires reduce rolling resistance but transmit road hazards at a speed where a pothole is a genuine problem. Something in the 40 to 50 mm range at moderate pressure is the sensible compromise for a fast commuter. Wheelbase and head angle matter more here than on a 20 mph bike, which is why purpose-built Class 3 commuters from brands like Specialized, Trek, and Gazelle feel planted in a way a converted cruiser does not.
Motor type and thermal headroom. Sustained 28 mph riding means sustained high output, which is a heat problem. Mid-drives handle it well because they operate through your gears and stay in an efficient rpm band, and quality geared hub motors do fine on flat ground. Lighting deserves a mention too. Class 3 riders are on roads with cars, often at commuting hours in winter darkness. An integrated light running off the main battery, with a rear light bright enough to be read at 200 feet, is not an accessory on this kind of bike.
What Class 3 gets you
- A speed differential with traffic that makes suburban roads workable
- Meaningfully shorter commute times on open road, often 20 to 30 percent
- Purpose-built commuter hardware: better brakes, lights, racks, fenders
- Full access to roads and on-street bike lanes everywhere the class is recognized
- Ridden at 20 mph, it is as efficient as any other class
What it costs you
- Excluded from many multi-use paths and most trails
- Minimum rider age of 16 in most states, so it is not a family bike
- Helmet required for all riders in several states
- Roughly half the range if you actually hold 28 mph
- Costs more, because the hardware to support the speed is not cheap
Who Class 3 is genuinely right for
Class 3 is oversold to people who will never use it and undersold to the people it was designed for. The dividing line is your route.
Buy Class 3 if: your commute is five miles or longer, runs mostly on roads posted at 30 to 45 mph, and does not depend on a multi-use path. You are replacing car trips rather than adding recreational rides. You are 16 or older and comfortable riding in traffic. You are willing to carry enough battery for the speed you plan to use.
Do not buy Class 3 if: your riding is mostly on greenways or paths, which is where the ban bites hardest. Your commute is under three miles, where the time saved is a couple of minutes. You ride mainly in a dense downtown, where traffic sets your speed anyway. You are buying for a rider under 16. You are nervous in traffic, since 28 mph is not the speed to learn on.
There is a middle case worth naming. Some riders buy Class 3 purely as headroom, ride at 22 to 24 mph most of the time, and value the fact that the motor is still helping instead of dropping out. That is a legitimate reason and it costs less range than holding 28. If that is you, the class restriction on paths is still the thing to check first.
Making the call
Class 3 is a tool with a narrow, well-defined job: making road commutes fast enough to compete with driving. On the right route it does that better than any other legal ebike, and the price is a set of rules that keep it off the paths where the other classes live comfortably.
Map your actual route before you shop. Mark every segment that runs on a separated path, and look up who manages each one. If more than a mile or two of your regular ride depends on facilities that exclude Class 3, buy Class 1 instead and take the access. If starting from a stop is the part of riding that gives you trouble, and speed is not the issue, Class 2 and its throttle solve a different problem and solve it well.
